Your Delaware consumer data rights
In effect
The Delaware Personal Data Privacy Act gives Delaware residents rights over the personal data that covered businesses collect about them. It has been in effect since January 1, 2025.
- Who or what it protects
- Delaware residents, in their dealings with businesses in Delaware or targeting its residents that process the personal data of at least 35,000 consumers, or of at least 10,000 consumers while earning more than 20 percent of their gross revenue from selling personal data.
- What you can do
- You can confirm whether a business processes your personal data and see it, correct it, delete data you provided or that it obtained about you, and get a copy you can take elsewhere. You can get a list of the categories of third parties it disclosed your data to. You can opt out of targeted advertising, the sale of your data, and solely automated profiling with legal or similarly significant effects. A business must get your consent to use sensitive data, and since January 1, 2026 it must honor an opt-out preference signal you send for targeted advertising and sales. Use the method in the company's privacy notice. It must respond within 45 days, which it can extend by 45 days, and tell you how to appeal if it declines. If a business does not respond, or you want to appeal further, you can submit a privacy complaint to the Delaware Department of Justice.
- Limits and eligibility
- The Delaware Department of Justice enforces the law; it gives you no right to sue. One request a year is free.
