Your Montana consumer data rights
In effect
The Montana Consumer Data Privacy Act gives Montana residents rights over the personal data that covered businesses collect about them. Changes that widened who must comply took effect on October 1, 2025.
- Who or what it protects
- Montana residents, in their dealings with businesses that do business in Montana or target its residents and that process the personal data of at least 25,000 consumers, or of at least 15,000 if more than 25 percent of their revenue comes from selling personal data. Banks, credit unions and insurers are exempt.
- What you can do
- You can confirm whether a business processes your personal data and see it, correct it, delete personal data about you, and get a copy of the data you gave it in a form you can take elsewhere. You can opt out of targeted advertising, the sale of your data, and profiling used for automated decisions with legal or similarly significant effects. Use the method in the company's privacy notice. It must respond within 45 days, which it can extend by 45 days, and tell you how to appeal if it declines; one request a year is free. You can file a complaint with the Montana Department of Justice's Office of Consumer Protection.
- Limits and eligibility
- Only the Montana Attorney General enforces the law, and it gives you no right to sue.
- Who oversees it
- Montana Department of Justice, Office of Consumer Protection
- The law
