Privacy & personal data

  • Your Texas consumer data rights

    In effect

The Texas Data Privacy and Security Act gives Texas residents rights over the personal data that covered businesses collect about them. It has been in effect since July 1, 2024.

    Who or what it protects
Texas residents, in their dealings with businesses that do business in Texas or offer products or services that Texans use and that process personal data. Small businesses, as defined by the federal Small Business Administration, are generally exempt, but they need your consent to sell sensitive data. State agencies, nonprofits, colleges and universities, financial institutions covered by federal banking privacy law, and organizations covered by HIPAA are exempt, as is some data covered by other laws.
    What you can do
You can ask a covered business to confirm whether it processes your personal data and give you a copy in a readable format, correct inaccurate data, and delete data you provided or that it obtained about you. You can opt out of targeted advertising, the sale of your data, and profiling used to make important decisions about you, such as for lending, housing, insurance, health care, education, jobs or basic necessities. Since January 1, 2025, you can also opt out of targeted advertising and sales through a browser setting, extension or device setting that signals your choice. Use the instructions in the company's privacy notice. It must respond within 45 days, which it can extend once by 45 days, and it must offer a way to appeal a denial. If it denies your appeal, it must tell you how to complain to the Texas Attorney General. A company may not retaliate against you for using these rights.
    Limits and eligibility
Only the Texas Attorney General enforces this law, and it gives you no right to sue. A company that receives a notice of violation has 30 days to fix it. Texas has a data broker registry, but it does not give you a right to have a broker delete your data.
